Please read these Terms and Conditions ("Agreement") carefully before engaging Timeless Creative for any Creative Image Services. By submitting a project order, signing a service agreement, or otherwise engaging Timeless Creative, you ("Client") agree to be bound by this Agreement in its entirety.
For purposes of this Agreement, the following terms have the meanings set forth below:
Timeless Creative provides professional photo retouching, enhancement, and post-production services tailored to the needs of each Client. Specific deliverables, turnaround timelines, file specifications, and pricing are detailed in the individual project order or service proposal provided to the Client prior to project commencement.
Timeless Creative employs a best-in-class blend of industry-leading software, professional editing tools, and Artificial Intelligence (AI)-assisted technologies. Our toolset may include professional image editing suites, AI-powered retouching and enhancement platforms, batch processing utilities, color science tools, and workflow automation systems.
The Client acknowledges and agrees that Timeless Creative may utilize AI Tools as part of its creative workflow. Such tools may be used for tasks including, but not limited to, intelligent masking, noise reduction, resolution upscaling, skin retouching, background generation or replacement, color grading, object removal, and content-aware editing. The use of AI Tools does not diminish the professional quality, human oversight, or creative judgment applied to every project.
To deliver the highest possible quality and to remain at the forefront of creative technology, Timeless Creative may utilize software features, plugins, or platform capabilities that are currently in a preview, beta, or pre-release state. Timeless Creative shall not be liable for output variations that may arise solely from the use of such preview-state features, provided that professional care and quality review are applied.
The Client is responsible for: submitting Project Files that are properly backed up and retained by the Client prior to delivery; ensuring that the Client has all necessary rights, licenses, and permissions to submit Project Files for editing; providing clear, complete project briefs and specifications to minimize revision cycles; and reviewing Deliverables promptly and communicating revision requests within the timeframe specified in the project order.
Project Files are stored exclusively on Timeless Creative's secure servers or approved cloud storage environments for the sole purpose of completing the requested Creative Image Services. Files will be retained on Timeless Creative's systems only for the duration necessary to complete the project and fulfill any agreed-upon revision period. Upon project completion and final delivery, Project Files and Deliverables will be purged from active production storage within thirty (30) days, unless an extended storage arrangement has been expressly agreed to in writing.
Timeless Creative will not sell, rent, trade, license, or otherwise transfer Client data, Project Files, Deliverables, or associated Metadata to any third party for any commercial purpose. Client data and Metadata are treated as confidential and proprietary to the Client.
Timeless Creative will not disclose Client data, Project Files, or Metadata to third parties except: to subcontractors or technology vendors engaged solely to assist in the performance of Creative Image Services, subject to confidentiality obligations no less protective than those in this Agreement; as required by applicable law, regulation, or valid legal process; or with the express prior written consent of the Client.
Unless expressly prohibited in writing by the Client prior to project commencement, Timeless Creative reserves the right to display Deliverables in its portfolio, website, social media channels, and promotional materials as examples of its work. The Client may opt out of this use by providing written notice at the time of project submission.
Subscription fees are billed monthly in advance. By completing this checkout, you authorize Timeless Creative to charge the selected plan amount to your payment method each month until you cancel. Cancellations must be submitted at least 5 business days before the next billing date to avoid the next charge. All fees are non-refundable once a monthly period has commenced and work has begun.
Upon receipt of full payment, Timeless Creative assigns to the Client all rights in the Deliverables produced for that project. Timeless Creative retains ownership of its proprietary tools, workflows, templates, and processes used in the production of Deliverables. Client retains all ownership rights in the original Project Files submitted.
To the maximum extent permitted by applicable law, Timeless Creative's total liability to the Client for any claims arising out of or related to this Agreement shall not exceed the total fees paid by the Client in the three (3) months immediately preceding the event giving rise to the claim. Timeless Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of competent jurisdiction located in Florida.
